The court has issued the clarificatory order.
The Branch 15 of the Davao City Regional Trial Court on Wednesday, August 28, issued a supplemental and clarificatory order regrading the temporary protection order (TPO) it issued to the Kingdom of Jesus Christ (KOJC).
According to the court, the TPO “did not cancel or nullify the processes related to the warrant of arrests [against Apollo Quiboloy and his co-accused.]”
It added that “both serve different purposes and are not contradictory with each other.”
“Our laws and jurisprudence require that the manner in which a warrant of arrest is enforced should be necessary and reasonable,” and “any act beyond its usual prescription must be with judicial imprimatur before it is carried out,” the Davao RTC underscored.
This supplemental order comes a day after the court ordered the Philippine National Police (PNP) Region 11 to cease actions threatening church members in the KOJC Compound in Davao City.
“This court under the current situation, sees the urgency to direct the PNP XI to immediately cease and desist from any act or omission that threatens the life, liberty, or security as well as the properties of the petitioners,” part of the order read.
Prior to the release of the supplemental order, Sec. Benhur Abalos of the Department of Interior and Local Government (DILG) said it will not desist from its operations, which aims to arrest Pastor Apollo Quiboloy.
The fugitive is facing multiple charges locally, including violations of child abuse and human trafficking laws.
Those are on top of other criminal charges and an outstanding warrant of arrest issued by the Federal Bureau of Investigation (FBI) in the United States.
